Election Commission Issue
Election Commission Issue: What Is the Current Controversy?
The Election Commission of India (ECI) is a constitutional body responsible for conducting elections and maintaining electoral rolls. Recently, the Commission has come under public attention because of disagreements among its own members over the Special Intensive Revision (SIR) of electoral rolls and the functioning of its digital voter database.
The issue is important not only from a political perspective but also for understanding Indian Polity, constitutional institutions, electoral reforms and the right to vote.
What Is the Main Issue?
The current controversy is linked to the Special Intensive Revision of electoral rolls, a process intended to verify and update voter lists.
According to an investigation published by The Indian Express, Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi have formally raised objections on several occasions concerning decisions related to voter registration, deletion and restoration of names, changes to voter-registration procedures and access to electoral databases. The report says the two Commissioners raised objections at least 14 times over 10 months.
These are reported disagreements within the Commission itself. The ECI has also faced wider public and political criticism over the SIR process, making the issue an important subject of discussion.
Why Is Electoral Roll Revision Important?
An electoral roll is the official list of eligible voters. Maintaining an accurate voter list is essential because it should include eligible citizens while removing entries that are no longer valid, such as duplicate, shifted or deceased voters.
However, the process must also provide appropriate opportunities for people whose names are questioned or removed to seek correction or restoration.
In West Bengal, the ECI told the Supreme Court that 27.16 lakh voters were removed during the SIR, while more than 22 lakh appeals seeking reinstatement had been filed. The Commission also reported a total of more than 38 lakh appeals involving both inclusion and deletion.
What About the Digital Voter Database?
Another important part of the controversy concerns the technology used for maintaining electoral rolls.
The two Election Commissioners, according to The Indian Express, raised concerns about what they described as the gradual centralisation of electoral-roll databases and the access available to statutory election officials. They also raised questions regarding changes to the digital system and the ability of ground-level Electoral Registration Officers to make corrections.
This raises an important governance question: How can technology improve election management while maintaining transparency, accountability and decentralised statutory responsibility?
Constitutional Importance
The Election Commission derives its authority primarily from Article 324 of the Constitution.
The Commission consists of the Chief Election Commissioner and other Election Commissioners. Under the 2023 law governing their appointment and service conditions, the functioning of the Commission involves decision-making by the Commission, with majority decision applicable when members differ in opinion.
Therefore, the current discussion also provides an opportunity to understand the relationship between constitutional authority, institutional independence and administrative decision-making.
